Sexually active young people over sixteen

Sexual activity involving a young person who has reached their sixteenth birthday, but is not yet eighteen, is not an offence in itself. However an offence may be committed (e.g. rape or gross indecency) dependent on the circumstances of the activity. Staff should always consider with a named or designated manager whether the activity involves the risk of significant harm to the young person.

Positions of Trust

It is an offence for anyone who is in a position of trust, or authority in relation to a young person, to engage in sexual activity with that young person.
